Terms & Conditions

1. Introduction 

  • Purpose: These Terms and Conditions ("Terms") govern your use of the Garden of Eden Matrimony website, mobile application, and community services offered through WhatsApp groups (collectively, the "Services"). 

  • Scope: These Terms apply to all users of the Services, including individuals seeking life partners for themselves or their offspring ("Users"). 

  • Acceptance: By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.    

2. User Conduct 

  • Eligibility: You must be at least 18 years of age to use the Services. 

  • Acceptable Use: The Services are intended solely for the purpose of finding suitable life partners within the Garden of Eden Matrimony community. 

  • Prohibited Activities: You agree not to use the Services for any illegal, fraudulent, or unauthorized purpose, including but not limited to:  

  • Harassment: Engaging in any form of harassment, including but not limited to, stalking, bullying, or making threats. 

  • Spamming: Sending unsolicited messages, advertisements, or promotions. 

  • Impersonation: Impersonating another person or entity. 

  • Hate Speech: Posting or sharing any content that is hateful, discriminatory, abusive, or offensive. 

  • Illegal Activities: Using the Services for any illegal activity, including but not limited to, money laundering, fraud, or the distribution of child pornography. 

  • Sharing Private Information: Sharing personal information of other users without their consent. 

  • Misuse of Information: Using information obtained through the Services for any purpose other than finding a life partner. 

  • Communication Standards: All communication within the Services must be respectful and courteous. Abusive, offensive, or discriminatory language is strictly prohibited. 

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.    

3. User Responsibilities 

  • Accurate Information: You are responsible for providing accurate and truthful information in your profile. 

  • Content Uploads: You are solely responsible for the content you upload to the Services, including but not limited to, photographs, messages, and any other information. You agree that you will not upload any content that:  

  • Is illegal, obscene, defamatory, or infringing. 

  • Contains viruses or other malicious code. 

  • Violates the privacy rights of others. 

  • Is misleading or deceptive. 

  • Compliance with Laws: You agree to comply with all applicable laws and regulations in connection with your use of the Services.  

4. Intellectual Property 

  • Ownership: Garden of Eden Matrimony owns or has the right to use all intellectual property rights in and to the Services, including but not limited to, trademarks, copyrights, logos, and designs. 

  • User Content: You retain ownership of the content you generate, such as your profile information and messages. However, you grant Garden of Eden Matrimony a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content for the purpose of providing and improving the Services.    

  • License Grant: Garden of Eden Matrimony grants you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.    

5. Disclaimer of Warranties 

  • "As Is" Disclaimer: The Services are provided "as is" and "as available" without any warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.    

  • Disclaimer of Accuracy: Garden of Eden Matrimony does not guarantee the accuracy, completeness, or reliability of any information provided by other users. 

  • No Endorsement: Garden of Eden Matrimony does not endorse or guarantee any particular user or profile. 

6. Limitation of Liability 

  • Disclaimer of Liability: In no event shall Garden of Eden Matrimony be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data loss, or loss of goodwill, arising out of or in connection with your use of the Services, even if Garden of Eden Matrimony has been advised of the possibility of such damages.    

  • Maximum Liability: Notwithstanding anything to the contrary herein, Garden of Eden Matrimony's total liability to you for any and all claims arising out of or relating to these Terms shall not exceed the amount, if any, paid by you to Garden of Eden Matrimony for the use of the Services in the six (6) months prior to the date of the claim.

7. Indemnification 

User Agreement: You agree to indemnify and hold harmless Garden of Eden Matrimony, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of any third party.    

8. Termination 

  • Termination by Garden of Eden Matrimony: Garden of Eden Matrimony may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including but not limited to:  

  • Violation of these Terms. 

  • Suspected fraudulent or illegal activity. 

  • Non-payment of any fees associated with the Services (if applicable). 

  • Inactivity for an extended period. 

  • Termination by You: You may terminate your account at any time by using the delete option within the app or by contacting our support team. 

9. Governing Law and Jurisdiction 

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Kerala, India, without regard to its conflict of law principles.    

  • Dispute Resolution: Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kerala, India. 

10. Changes to Terms 

  • Right to Modify: Garden of Eden Matrimony reserves the right to modify or update these Terms at any time. 

  • Notification: We will notify you of any material changes to these Terms by posting the revised Terms on the Services and/or by sending you an email notification. 

  • Continued Use: Your continued use of the Services after the effective date of any such changes constitutes your acceptance of the revised Terms.

12. Privacy Policy

13. Severability 

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permissible by law. 

14. Entire Agreement 

These Terms constitute the entire agreement between you and Garden of Eden Matrimony with respect to your use of the Services and supersede all prior or contemporaneous communications, representations, and understandings, whether oral or written.
